We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. ImportancePrevious studies of post-acute COVID-19 syndrome have focused on critical cases with severe disease. However, most cases are mild to moderate in disease severity.ObjectiveWe aimed to examine cognitive outcomes in cases of non-critical, mild-to-moderate COVID-19. Design, Setting, and Participants: In this cross-sectional study, we enrolled 72 adults aged 22 to 65 years in Central Texas who had non-critical, mild-to-moderate COVID-19 infection between 13 January 2021 and 20 April 2021.Main Outcomes and MeasuresWe remotely administered cognitive-behavioral testing to determine the frequency of (...) cognitive impairment and examine demographic, clinical, and psychosocial contributors to impairment.ResultsThe frequency of objective cognitive impairment was 40%. The largest number of participants showed impairment on a measure of executive functioning. Attention and processing speed was more impaired in males. Males endorsed lower adherence to social distancing guidelines, which was in turn associated with cognitive impairment across participants. Younger age was correlated with impairment but was also associated with racial/ethnic minority status and increased psychological symptoms. Moderate COVID-19 severity was associated with attention/processing speed impairment, increased pain, and higher number of COVID-19 symptoms.Conclusion and RelevanceMild or moderate COVID-19 infection may be associated with cognitive impairments, especially in the domain of executive functioning. "My experience is what I agree to attend to," wrote William James (1890) nearly a century ago in his Principles of Psychology. Although certainly not the first to recognize the importance of attention in man's experience--poets and philosophers throughout history have touched upon the concept in one way or another-James deserves credit for having accorded attention a central role in the systematic study of the mind. With the advancement of psychology since that time, except during the behaviorist digression, the concept (...) of attention has been an integral part of many prominent theories dealing with learning, thinking, and other aspects of cognitive functioning. Indeed, attention is an important determinant of experience from birth throughout development. This has been an implicit assumption underlying our view of cognition since the writings of Charles Darwin (1897) and Wilhelm Preyer (1888) as well as James, all of whom offered provocative insights about the developing child's commerce with the environment. Al though systematic research on attention in children was slow to pick up during the early part of this century, interest in the developmental study of attention has expanded enormously in recent years. Although many researchers theorize that primitive numerosity processing abilities may lay the foundation for whole number concepts, other classes of numbers, like fractions, are sometimes assumed to be inaccessible to primitive architectures. This research presents evidence that the automatic processing of nonsymbolic magnitudes affects processing of symbolic fractions. Participants completed modified Stroop tasks in which they selected the larger of two symbolic fractions while the ratios of the fonts in which the fractions were printed and the overall sizes of the (...) compared fractions were manipulated as irrelevant dimensions. Participants were slower and less accurate when nonsymbolic dimensions of printed fractions were incongruent with the symbolic comparison decision. Results indicated a robust basic sensitivity to nonsymbolic ratios that exceeds prior conceptions about the accessibility of fraction values. Results also indicated a congruity effect for overall fraction size, contrary to findings of prior research. These findings have implications for extending theory about the nature of human number sense and mathematical cognition more generally. (shrink)

Moral distress, is, at its core, an organizational problem. It is experienced on a personal level, but its causes originate within the system itself. In this commentary, we argue that moral distress is not inherently good, that effective interventions must address the external sources of moral distress, and that while there is a place for resilience in the healthcare professions, it cannot be an effective antidote to moral distress.

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Women have consistently higher levels of disgust than men. This sex difference is substantial in magnitude, highly replicable, emerges with diverse assessment methods, and affects a wide array of outcomes—including job selection, mate choice, food aversions, and psychological disorders. Despite the importance of this far-reaching sex difference, sound theoretical explanations have lagged behind the empirical discoveries. In this article, we focus on the evolutionary-functional level of analysis, outlining hypotheses capable of explaining why women have higher levels of disgust than men. (...) We present four hypotheses for sexual disgust and six for pathogen disgust, along with testable predictions. Incidental findings in research with human participants may have implications for a person’s present health or future health outcomes. Current guidelines focus on methods for handling and reporting incidental findings from biological test data but incidental findings might also arise from non-biological tests. This article presents three examples in which the results from non-biological test data can be predictive of future disease and should be disclosed to research participants. Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. Attention has recently been proposed as the mechanism underlying the cognitive effects associated with bilingualism. However, similar to bilingualism, the term attention is complex, dynamic, and can vary from one activity to another. Throughout our daily lives, we use different types of attention that differ in complexity: sustained attention, selective attention, alternating attention, divided attention, and disengagement of attention. The present paper is a focused review summarizing the results from studies that explore the link between bilingualism and attention. For each (...) level of attention, a brief overview of relevant theoretical models will be discussed along with a spotlight on paradigms and tasks used to measure these forms of attention. The findings illustrate that different types and levels of attention are modified by the variety of bilingual experiences. Future studies wishing to examine the effects of bilingualism on attention are encouraged to embrace the complexity and diversity of both constructs rather than making global claims about bilingualism and attention. Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)
